How do I manage my subscription?

You can change your subscription at any time in your customer account:

You can attach a different payment card to your subscription by clicking "CHANGE PAYMENT METHOD". If your Gaminate stock has run out faster than you had planned you can have your subscription products shipped immediately by clicking RENEW NOW.

If you would like to change the flavour or quantity of products in your subscription, you can do so again by going through the ordering process - if you swap products for others of the same value when you click pay, no additional funds will be taken from your account.

Subscription regulations

§1 Definitions

Whenever the following phrases and terms are used in the Regulations, they shall be understood to mean:

Subscription panel - the tab on your User Account for managing your Subscription, located in the "My Account" section.

Subscription payments - a form of payment that allows the Customer's account to be debited periodically every chosen period of time (e.g. every 2 weeks) via a payment card, without the Customer having to execute a transaction in the Payment Operator's system each time.

Subscription Terms and Conditions - these Terms and Conditions, which set out the terms of use of the Subscription and the conditions for making Recurring Payments, available at (insert address)

Terms of Service - Terms of Service of Gaminate.pro, defining the rules for concluding distance delivery contracts, the rules for performing these contracts, the rights and obligations of the parties and the rules of the complaint procedure, available at https://gaminate.pro/regulamin/.

Subscriber or Customer - a natural person, including a Consumer, who has full legal capacity and is over 18 years of age, who uses the Subscription.

Subscription - the service provided by Gaming Supplements under the Subscription Terms and Conditions, consisting of the continuous delivery of Products to the Customer in exchange for the making of Recurring Payments.

Gaming Supplements - Gaming Supplements sp. z o.o., Nowy Świat 33 lok.13, 00-029 Warsaw, Company entered in the Register of Entrepreneurs in the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, KRS no. 0000801283, NIP: 7010942894, REGON: 384220149, which is the owner of the online shop Gaminate.pro.

§2 General provisions

The Subscription Rules set out the rules for the use of the Subscription, in particular the rules:

  • activation, modification, cancellation and expiry of the Subscription;
  • to make recurring payments for Subscription;
  • the granting of discounts to Subscribers;
  • to make complaints on matters relating to Subscriptions and Recurring Payments;
  • withdraw from the Agreement.

All expressions used in the Subscription Rules shall have the meaning ascribed to them in the Service Rules unless a different meaning is expressly assigned under the Subscription Rules.

§3 Rules for the use of subscriptions

In order to activate and use the Subscription, it is necessary to have a payment card accepted by the Payment Provider. The specific technical requirements for payment card types may depend on the guidelines of the Payment Provider.

In order to activate the Subscription, the Customer should add a payment card, specifying its number, expiry date and CVV/CVC code. The Customer should also read and accept the Subscription Terms and Conditions and the Stripe Payments Europe Rules.

Use of the Subscription is voluntary.

When placing an Order, the Customer has the option to choose between one-off payment and activation of the Subscription. Activation of the Subscription has effect from the time of the first effective charge to the payment card.

A customer can only have one active Subscription.

The use of the Subscription does not exclude the possibility of placing and paying for a single Order outside the Subscription.

A Customer who is a Subscriber who places an Order and selects the option "Order in Subscription" makes a change to the active Subscription.

The Customer manages the Subscription through the Account, including a dedicated Subscription Panel.

In the Subscription Panel, the Customer can, in particular:

  • obtain information on the price of the Product from the last and subsequent Order;
  • obtain information on the payment deadline;
  • change the date of the Cyclical Payment;
  • change of delivery address;
  • change of payment card;
  • cancellation of Subscription.

The Subscriber has the option to change the date of the Cyclical Payment by extending this date, or shortening it depending on the options available in relation to the original payment date.

The Subscriber has the option to change the Product(s) within the Subscription.

The Subscriber has the option to make other changes to the Subscription to the extent indicated in the Subscription Panel.

The Subscriber is informed of the effect of any changes made to the Subscription each time by e-mail.

§4 Duration of the Subscription

The subscription lasts indefinitely from the moment of activation until cancellation or expiry.

The Subscriber may cancel the Subscription at any time via the Subscription Panel. A confirmation of cancellation of Subscription will be sent to the Subscriber's email address.

Cancellation of a Subscription has immediate effect.

The subscription expires in the event of:

  • four unsuccessful attempts to debit the payment card in accordance with § 5 (5) of the Subscription Terms and Conditions (in particular due to insufficient funds to make a Recurring Payment, the payment card not being valid at the time of the attempted debit, etc.);
  • delete the User Account.
  • The termination of the Subscription shall have effect from the occurrence of the event referred to in paragraph 4 above.

§5 Recurring payments

By purchasing Subscription Products, the Subscriber agrees to have their payment card regularly charged every 2 or 3 weeks and every month or 2 months, according to the offer they have accepted.

As part of the Recurring Payments, the Subscriber has the option of storing payment card details and a standing direct debit order. The payment card data will be stored by the Payment Provider.

The Subscriber is obliged to maintain, during the period of use of the Subscription, the payment card which he/she has indicated for the purpose of making Recurring Payments and to provide the funds necessary for their execution.

Gaming Supplements shall inform the Subscriber, at least 14 days before the next Recurring Payment, of the changing terms of the contract (change of amount).

In the event of a refusal to authorise and cancellation of the Recurring Payment, Gaming Supplements will attempt to charge the payment card again in 1, 3 and 5 days from the first attempt respectively. After the fourth unsuccessful attempt to charge the payment card, the Subscription will expire.

Gaming Supplements shall be liable for Recurring Payments for which the amount is higher than the amount the Subscriber can expect, taking into account the type and value of previous payments, the provisions of the payment services agreement and the relevant circumstances of the case.

§6 Discounts

The subscriber on the first Recurring Payment receives a discount of 10% and  is charged the amount of 90% of the basic Price to be paid. On the second and each subsequent Recurring Payment, the Subscriber pays the same amount as for the first payment (taking into account the discount).

Discounts do not combine with other promotions, unless otherwise stated in the rules of the respective promotion/programme.

§7 Complaint procedure

The Subscriber has the right to lodge a complaint on matters relating to Subscription and Recurring Payments.

Complaints should be submitted by e-mail to: sklep@gaminate.pro or in writing to: Gaming Supplements sp. z o.o., Nowy Świat 33 lok.13, 00-029 Warsaw.

The complaint should include:

  • name;
  • mailing address;
  • order and/or transaction number;
  • a description of the circumstances justifying the complaint;
  • a request as to how the complaint should be handled.

Gaming Supplements will respond to the complaint request immediately, but no later than within 14 days of receipt of the complaint. A response to the complaint will be sent to the address provided by the Subscriber or in any other manner provided by the Subscriber. If Gaming Supplements does not respond within the aforementioned period, it will be deemed to have acknowledged the complaint.

§8 Withdrawal from the Agreement

With regard to the right of withdrawal from the Subscription Agreement, the provisions of the Terms of Service (§ 7) shall apply.

§9 Final provisions

Changes to the Subscription Rules shall be made in accordance with the procedure set out in the Service Rules.

For matters not regulated in the Subscription Rules, the provisions of the Service Rules shall apply.

The regulations come into force on 01.02.2023.
